ArtHub ATX — Terms of Service

1. Agreement to these terms
By accessing or using arthubatx.com or any related service we provide (the "Services"), you agree to these Terms of Service. If you don't agree, please don't use the Services.
2. Who may use the Services
You must be at least 18 years old, or the age of majority where you live, to use the Services. By using them, you represent that you meet this requirement and that any information you give us is accurate and current.
3. Your account
Some features may require an account. You're responsible for keeping your login credentials secure and for all activity that happens under your account. Tell us promptly at Hello@arthubatx.com if you believe your account has been used without your permission.
4. Acceptable use
When using the Services, you agree not to:
Violate any law or regulation;
Impersonate another person or misrepresent your affiliation with anyone;
Upload viruses, malicious code, or anything designed to disrupt the Services;
Attempt to gain unauthorized access to our systems or another user's account;
Scrape, harvest, or collect information about other users;
Use the Services to send unsolicited commercial messages;
Post content that is unlawful, harassing, defamatory, or infringes someone else's rights.
We may suspend or terminate access for anyone who violates these rules.
5. Our content
The Services and their contents — text, graphics, logos, photographs, layouts, and software — are owned by us or our licensors and are protected by copyright, trademark, and other laws. You may view and use the Services for their intended purpose, but you may not copy, reproduce, distribute, modify, or create derivative works from our content without our written permission.
6. Content you submit
You keep ownership of anything you submit to us. By submitting it, you grant us a non-exclusive, royalty-free license to use, store, display, and reproduce that content as needed to operate and improve the Services. You represent that you have the rights to submit it and that it doesn't violate anyone else's rights.
We may remove any submitted content at our discretion.
7. Third-party links and services
The Services may link to or integrate with websites and services we don't control. We're not responsible for their content, policies, or practices, and a link is not an endorsement. Your use of a third-party service is governed by that party's own terms.
8. Disclaimer of warranties
The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any information provided through them is accurate or complete.
9. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of your use of or inability to use the Services. Our total liability for any claim relating to the Services will not exceed one hundred dollars ($100) or the amount you paid us in the twelve months before the claim, whichever is greater.
Some jurisdictions don't allow these limitations, so parts of this section may not apply to you.
10. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your submitted content, or your violation of these terms or of any law or third-party right.
11. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these terms. Sections that by their nature should survive termination — including content ownership, disclaimers, limitation of liability, and indemnification — will survive.
12. Governing law and disputes
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute arising from these terms or the Services will be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the jurisdiction of those courts.
13. Changes to these terms
We may update these terms from time to time. When we do, we'll revise the effective date above. Material changes will be posted before they take effect, and your continued use of the Services after that means you accept the updated terms.
14. Entire agreement and severability
These terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Services. If any provision is found unenforceable, the rest stays in effect.
